FWW Successfully Defends Ski Resort in $4.6 Million Wrongful Death Lawsuit

12/16/2013

After an eight-day trial and deliberating for about two hours, a Multnomah County jury found in favor of Mt. Hood Ski Bowl in a wrongful death lawsuit filed by the family of Taylur DeWolf.

Mt. Hood Ski Bowl was the sole defendant in the suit where plaintiff was seeking $4.65 million in damages arising out of a January 2012 snowboarding accident.

Farleigh Wada Witt litigator Brad Stanford successfully defended Ski Bowl in the multi-day trial arguing that Ski Bowl was in no way responsible for the accident and that DeWolf's lack of reasonable control led to her untimely death. The jury found 9-3 that Ski Bowl was not at fault in DeWolf's death.

"I'm a life-long skier and former ski patrol volunteer and it's tragic whenever anyone dies on the mountain," said Brad. "But, I've skied Ski Bowl on numerous occasions and have represented Mt. Hood Ski Bowl for twenty years. I see first-hand what a quality recreational experience they provide."

Brad's practice focuses on general litigation, business litigation, products liability, and insurance defense, with particular expertise in ski area risk management. He speaks frequently on litigation and risk management issues related to resort and ski area facilities, and is past president of the Association of Ski Defense Attorneys.
