Mark has tried cases in more than 50% of the counties in Oregon as well as five other states. He is an experienced, well-traveled litigator who uses his invaluable insights to help solve all types of legal disputes with intelligence, integrity, and civility.
His practice focuses on complicated and significant financial disputes, including civil litigation, professional malpractice, personal injury, large asset non-custody divorce proceedings, estate administration including conservatorships, guardianships, trusts, probates and estate planning disputes. Mark is an exceptional communicator who quickly understands the essence of his clients' needs. He works on cases from beginning to end, including through appeal if necessary, which allows him to take what he learns and apply it to other cases.
Legal disputes are stressful, but Mark makes his clients feel comfortable and respected while he fights for them. He is mindful of doing what is in the best interests of his clients, whether that is considering settlement options or taking a case through trial. Representative Matters
Civil Litigation, Business DisputesSuccessfully defended client in a $2 million breach of contract suit – case was dismissed and client was awarded more than $300,000 in attorney fees
Successfully defended client in a real estate transaction lawsuit – trial court agreed the lawsuit should never have been filed and awarded client over $300,000 in attorney fees as sanctions
Successfully defended a two-year litigation requesting the imposition of a conservatorship over a wealthy elderly person
Obtained a judgment after trial of an elder abuse case exceeding $700,000 including attorney fees, and nullified estate plan obtained by undue influence
Professional Malpractice
Successfully settled substantial accounting, legal and medical malpractice matters, some involving well over $1 million in recoveries for clients
Received jury verdict for approximately $1 million in business legal malpractice lawsuit, and settled medical malpractice claim for $1.3 million
Personal Injury
Resolved several sizable personal injury matters each year – by trial, mediation, arbitration, and negotiation
Large Asset Non-Custody Divorce
Resolved several divorce disputes annually involving significant support issues and valuation of assets ranging from real estate to businesses
Estate and Trust Disputes
Regularly represent clients in estate planning disputes, including probate and trust litigation, will contests, family disputes with significant assets and appointment of guardianships and conservators
Successfully represented client in elder abuse case and was able to protect client’s financial assets
